DPW presents annual stormwater management program update to Select Board
Staff outlined EPA-required control measures, catch basin cleaning progress, and water quality testing efforts.
A DPW staff member presented Marblehead’s stormwater management program, which is regulated under an EPA permit requiring six minimum control measures: public education, public involvement, illicit discharge detection and elimination, construction site runoff control, post-construction stormwater management, and good housekeeping/pollution prevention.
Key highlights included:
- Annual catch basin cleaning, with orange markers placed to indicate completed cleanings; basins filled 50% or more must be re-cleaned
- Partnership with Salem Sound Coastwatch for public education, including annual mailers with dog licenses and fourth-grade outreach
- Approximately 100 storm drain medallions installed in Old Town in partnership with a community group as part of a World Ocean Day effort
- Dry and wet weather bacteria testing at approximately 86 outfall locations; approximately 80% of dry weather testing completed this year
- GIS system being updated to track catch basin data more effectively
- Dog waste dropped into catch basins identified as a significant bacteria source, particularly on the Neck
A board member noted that the Bessom Street infrastructure project had uncovered multiple illicit connections, leading to a measurable reduction in bacteria levels at that outfall.

Interim Finance Director presents year-end budget transfer list to Select Board
Transfers totaling approximately $260,095 were drawn primarily from surplus health insurance appropriations.
The interim Finance Director explained that the Finance Department issued memos to all departments in early June to identify year-end budget shortfalls, followed up with departments running over budget, and reviewed the transfer list with the Finance Committee prior to this meeting. The committee approved the list.
All transfers except the highway department transfer originated from a surplus in the health insurance fund, which has historically been over-budgeted. A board member emphasized that year-end transfers are a routine annual process.

Select Board approves common victualer license for Eat Well Kitchen and one-day license for The Beacon
New owner Fernanda de Oliveira received a license for Eat Well Kitchen; The Beacon received a one-day outdoor entertainment license for its first anniversary.
Eat Well Kitchen: Fernanda de Oliveira, who has worked at Eat Well Kitchen on Atlantic Avenue for two years, purchased the business and applied for a common victualer license. The board approved the license for hours Monday–Sunday, 8 AM–4 PM, with a seating capacity of 16, subject to all applicable inspections and fees.
The Beacon (143 Pleasant Street): The board approved a one-day outdoor entertainment license for the patio area on June 30, 2022 (Thursday), from 12 PM to 4 PM, to celebrate the restaurant’s first anniversary. A board member noted that any future entertainment licenses would require a separate return to the board.
Fernanda de Oliveira (Eat Well Kitchen owner)
Board approves two contract amendments for police station painting and State Street restroom
Police station painting contract increased $4,000 for rotted wood repairs; restroom project increased $2,903.18 for freeze-related plumbing repairs.
Two contract amendments were approved:
-
Police Station Exterior Painting – Contract with John Florissant increased by $4,000 due to discovery of rotted wood not visible during initial inspection. Funds are within the project’s approved contingency.
-
State Street Restroom Project – Contract with MGS Construction increased by $2,903.18 for unanticipated plumbing repairs related to winter freeze damage and installation of automatic locks. Funds are within the $550,000 state grant allocation for the project. A board member inquired about a timeline for completion, and there was an indication the project was being pushed to open before the summer season.
Board members note rail trail grant application and new accessibility sling lift at State Street Landing
Town applied for a Mass Trails Grant for bike path design from Lafayette Street to Lees Mills; a Hoyer lift was dedicated at State Street Landing.
Mass Trails Grant: A board member described an application for a Mass Trails Grant in which Marblehead is the lead community with Salem participating. The grant would fund design and permitting for a bike path extension from where the Salem bike path ends on Lafayette Street through to Lees Mills, consistent with the rail trail master plan. The design would feature decomposed granite surfacing, improved bridges for accessibility, and restored harbor views.
State Street Landing Sling Lift: The Marblehead Disabilities Commission held a dedication ceremony for a new sling lift (Hoyer lift) installed at State Street Landing — described as the first of its kind on Marblehead Harbor. The lift enables residents with mobility limitations to safely board boats. It was funded by a private donation from the Mariners of Marblehead and Jim Moses. Harbor Masters and Disabilities Commission members attended.
Planning Board Note: A board member reported attending a Planning Board meeting where accessory dwelling units were discussed; the discussion was described as positive.

3:17 Regulated by EPA under six minimum control measures that I’ll talk about in Greater detail and the stormwater management plan that Annie was referring to is a living document that we implement this for the time. next slide
3:34 So some unintended consequences with drainage water that lands on the road goes down. The drain goes out to the ocean. If you have a lot of fertilizer for example, or if you have a poop bag that gets dropped into a catch Basin that would then leave into the ocean. We do have control measures that we try to mitigate some of these we do annual catch facing cleanings, and I’ll talk a little bit more about that, but Like I said all roads lead to the ocean all drains. next slide
4:12 So the EPA permit has these six minimum control measures. I’ll go through those in Greater detail. But these are basically how we the town of Marblehead is regulated next slide.
4:25 The first is public education. So the town partners with Salem sound coastwatch. Oh, I think one back.
4:35 And they have for public education. So we do this year. We did start with an annual Mailer in the dog license for the license returned. We have we educate all the fourth graders in the community regarding stormwater and the water cycle. There’s a link to Salem sound on their website. They have their own educational and information sessions that we partner with and so that partition example for many years. So that’s for our public education for the next slide public involvement. We offer an opportunity to comment on our stormwater management plan each year. That’s why I’m here with you all today. So that makes so we want to make sure that the public has an opportunity. Our stormwater
5:21 management plan is posted on our website year-round and the contact information there for any questions or comments that we get throughout the year. Illicit discharge detection and elimination we do an annual training for Municipal Employees to make sure that we are abreast at catching and identifying any illicit connections that for discharges that we see there’s different types of discharges. It’s basically anything that’s not stormwater.
5:52 Is illicit so there’s different direct and indirect and you can see the pictures there, but we are educated again Pathways. It’s a big one call highlight that again, but these are different things that we are looking through for our permit. this one instruction site runoff control these next exercise are very similar. There is construction site runoff control and post construction stormwater management. These inspections are completed in partnership with the building department and the Conservation Commission, but generally once the water enters a town drain than it falls under our station. So then this one and the next one, they’re very similarious and these would be requirements. You’ll get in your permit exactly one of those departments. That’s how
6:38 you exactly and then the next one. My favorite Good Housekeeping and pollution prevention so that this is the bread and butter here for us. So as you can see, this is a catch Basin all of our catch basins have what’s called a sump so that that is basically a collection area. So if there’s for example a street sweeper that goes by and it brushes Street sweepings into to our catch phase and it’s an opportunity to collect that sediment application to prevent it from running out to the ocean or to the outfall so you can see the sediment chamber there all of our new catch basins are installed with these hoods, which is basically like a downspout so that keeps any sediment from glowing off and has it settle in that catch Basin. So that
7:25 is an opportunity for us to mitigate. What is actually going out into the ocean. So we also do inspections of our sites or Crosstown and that’s all part of our Good Housekeeping and opportunities to prevent pollution before it gets out there. Um, so our progress each year is documented as part of our annual report. This is a picture of our annual report that is posted on epa’s website and maintain there. So today the conclusion of year four and we work on this report and Report over the summer and it gets reported to EPA in September and September and so that will have a new one at the end to report on this year. So that’s the overview of
8:11 our program and our our implementation if there’s any anything here is actually why we’re here today is more questions or discussion. This is you know, what we like to public involvement. Yeah, we realize a lot of people don’t even know things are on the website. They don’t generally go to the website to read it. It’s a little dry to read also. you know, we do appreciate even if you’re reading it throughout the year send a comment and it will get adapted and reviewed and changed what needs to be we’ll make thank you really brought it to life if it’s interesting presentation any comments from the board and yeah, I’ve noticed some They’ve been cleaned out to catch basins last week in this week, which is crazy. Seeing them all around and you say have waste
8:57 is one of the biggest Drivers of this it’s fertilizer. So the town of Marblehead that Uka primary regulates us for bacteria. So we’re looking at bacteria numbers. And so we do find and we found I know there’s a picture we couldn’t find but of the clamshell from the catch Basin with a dog a full of dog poop bags. Yeah, so over 100, there’s just they’re neighborhoods that are difficult. They’re actually in the neck is a tough one. Yeah. So many people work dogs out there. Yeah. It’s really not a receptacle. Oh, that’s the plus with having the song because it does stop it. But unfortunately the water sits there long enough. It’s contaminated. It’s getting warm body that gives off. Yeah, you’re cool
9:43 a lot. So, you know it is it can be a sanitary. Yes or issue, right? And that’s what the sewer Department’s working on as well. We’ll have some testing coming up this summer. But you know, a lot of times it is either passing through, you know, the woods you can also be a huge piece or people actually just wrong. Is a big problem. Yeah, Jackie small question the greats in my on my street each has a little orange is does that mean that they come and it’s been done and it’s okay or yep. So maybe actually has brought our our implementation of the program up dramatically, but in 2003 when they started with the catch Basin cleaning, that’s what
10:31 they would do. They would Market to say they cleaned it then we would go out to double check your view to make sure that they cleaned it. We obviously see all the catch facing material that comes back it comes back to the lower yard. It’s held there and then it is disposed of registered side. So we know we see we want to make sure everyone is done phase two of this permanent has required when you clean it wants if it has 50% or more sump pump is 50% bill. You have to go back out and clean another time then here.
11:03 Here’s a plug for our GIS. So our GIS is old needs to be updated. It’s in the process of being updated. But Maggie has been able to get.
11:13 Now that’s out into the hand that people they’re marking it they’re putting so right now we have that table and data that can go right into our GIS program and then we’ll be able to follow it and do all the bunch of yeah. Yes cool things this one. Geographic information. Just okay. Thank you table behind the map that tells you what data is associated energy. But I can talk for it. There’s a group that came out. I can’t remember if it was last year or before that air was Salem sounds watch or maybe sustainable that put the markers down like some of the drain catches down at Old Town like, you know, just reminding people that this goes to the water. I don’t know how like what how much that cut like how many they hit with
12:00 those little signs, but they’re they see them should we have a bunch of different sides? I’ll even think about the future. So every casting actually says the strings to the ocean but people don’t really see that then they were markers that you can put in which have a tough time in this environment this day then they’ve done Street painting in the past but not everybody likes reading, you know, say along with that huge things which were cool, but they don’t fit everywhere, right? Yeah, and I know Maggie has been working with a group last year. We came in front of the board in I It wasn’t capable May and we came in partner with example Marblehead and they actually purchased those right those medallions and did they installed excluded 100
12:47 in Old Town downtown area? It was a part of their world Ocean View. So yeah, so we were partners with them, but I don’t believe in additional installations. That’s right, but it was a hundred and like mormonsible areas that kind of that’s a reminder of you think it’d be helpful to have them. I think we need to see how the first hundred do like to build through like two Winters to make sure they just don’t. Oh, yeah, and then if they say then I think they were definitely an investment. They’re not they’re not cheap either. So there’s fine, you know for is there fine for doing for? First you’re using you know, putting dog weights down the drain. I think it’s just fine. Yeah.
13:34 So is most of the storm water trade budget you said is consumed with compliance with these regulations. So trying to find so you have a test that goes poorly. This is the most frustrating thing in this case. So you then work your way backwards. And try to pinpoint where it’s coming from so you can spend a lot of money on Investigation got chance. Um, the annual also have the catch facing cleaning that happens every year that’s a big piece of it removing the catch facing cleaning properly. That’s another huge piece of it. This reports completing. This report is another large piece. You are also joining with Salem sounds so we are to pay sales out to be part of it. So and
14:20 then it kind of construction you have you generally are having it to find holistic connections as you go the dream that just went that they just finished Beyond Street project very long. They just found one man. When we went down the big dream project. We found multiple that were attached to the wrong one or your sewer goes through your drain and it’s broken there. So by replacing all those big old culverts, we got a lot. We actually saw a really great reduction in Riverhead from that project so in Goldberg comes that were coming out there. So it’s you know, it’s definitely worth it. And now you have to buy hoods. So when you install a catch base and your insult words on who catch facings, so they have the correct sum and then you have to buy a hood which is expensive on top of
15:08 that. So the hood is that plastic like snored Village it’s talking about and what that does is that comes out of your outlet pipe and it drops down below your storm water in your stock. So the oil is floats on top of water. So that doesn’t allow it to go out the other thing because it wouldn’t stop that and then the set and it drops to the bottom so we get stirred up and it’s still down so you it’s trying So it’s basically cleaning it storm water doesn’t need to be cleaned away sanitary surgery. That’s the one piece you have to watch because you know, you don’t want to treat all these sanitary it would be so expensive and it really is basically. it’s
15:45 yeah, um, I was interested to hear about the the song designer. That’s pretty cool. One question I have is in addition to your regular maintenance. Is that kind of discharge on testing that occurs and in fact data regarding that? Yes, so we do completely annual testing program this year. Our goal was to complete weather testing. I believe we got about 80% of that and that’s requirement to be completed button and the next permit here. So we have dry weather testing for all of our alcohols 86 of the number in my head that I might be out with you basically at number of alcohol and then I might be all I do though, and then the we dry weather
16:33 testing and wet weather testing to kind of see a Baseline and a comparison for when it rains what we end up seeing for concentrations of bacteria. And again, we’re testing for bacteria. Any Electronics? Great presentation very good.
16:51 Comments because oh, yeah, I’d like to open up any any public comments. thoughts Okay. I’d like to bring this public hearings close and thank you very much. Thank you. Good job, mate. I’m saying. Happy boy. Yes. Thank you.
17:18 Okay. Next up is my program interim Finance director to talk to us about year-end transfers or morning.
17:30 Take it away. Thank you for having me this morning. So in front of you you should have the list of transfers that you know this fiscal year. This was presented to in the group. committee on Tuesday morning and nothing has changed from stuff on the left side is is where all these ones will be going to and on the right side is where everything from I’ll go through our process and then walk through each of these items and feel free to stop them asking questions for the moment I have so we submit the finance department submitted a memo to all departments early June we went there but
18:19 we Let that resonate with the Departments and Then followed up over the next a couple times over the next couple weeks. Once we got to last week, we reached out to any Department that was either over budget or or getting very close just to ensure that that they had funds to get through physical year or if they needed to encumber anything or if we needed to do one of these selling and transfers then we fully understood what that was going to look like. Like I said, we reviewed this with with finance committee, and that was approved. So I can walk them each of these these light line items. The first one is and so all the transfers aside from the highway department are coming from our our health insurance fund
19:05 which has historically from one of the week has been over budgeted. So that that gave us some some of these phones might not just by Gaming on interrupt. I just like the emphasize this these transfers occur every year. Yes as a matter, of course. Yeah, it’s kind of trueing up the budget exactly.
19:27 So the first the first line item is trash disposal. And that was a recommendation from the director of health and waste and the reason for this is trash rates have just gone up and this is anticipating in June bills and just those increase in fees over the year. The next line item is from the highway department. So this one is actually coming from the salary and moving into the expense and the the driver for Eating the transfer was due to Personnel shortages over the year. There was an opportunity to make the the folks at work at this department a lot safer make their job a lot more efficient in some of these.
20:14 Larger items contributing to the 79,000 are the street sweeping which is not the budget. There’s a broken broken door that houses equipment that needs to get in but awesome to see lots. There’s a little lift and then there’s there’s
20:34 partitioning to that
20:37 The next item is legal. So this is actually over budget right now by about 5700. We increase that anticipating and a year bills. Reached out to the our legal teams that they got to pay from this budget item and they did not know what those feet what those bills were gonna be. So this is is just looking at historical data and what what those things? Yeah, so The next one is what Police Department we are moving 20,000 from health insurance into overtime. And this was due to unanticipated retirements through two unanticipated trials throughout the year for 33,000
21:24 Police Department received to cover about 13,000 of this and the reason would be into the overtime line item is that is the budget item that has fallen far on over budget. I’m sorry due to silence. Okay. The next one is Street lighting and so this is an anticipated bill this this for June this much item is already over about 2,500 and we just looked at the worst case. The high school that we would have received this year and had a response to this much better just to make sure we are covering this it should be less than that due to this. The light is the days are longer so they should be as assignment. Just want to make sure we cover that.
22:12 Next is parking tickets. And this is already over about 12,000 and where we’ve reached out to our deputy collector and a sustainability should be about $800. This is due to hire Partnerships throughout the year. They do a lot of work a lot more Administration.
22:30 For us just response.
22:34 The next one is unemployment within the cemetery. This is wasn’t an unanticipated unemployment claim for about 10,700. So other without this they would have been well within budget but they did have this unemployment claim kind of driving up their salaries over here. The next is on traffic lights. So this is repair of existing traffic lights. It’s already over about 3,600 and this contingency for the final month and burning system. The next one is Street Maintenance for public laws. This is also in the highway the highway department and this is just for paid. It’s
23:23 Of a publicly a lot. That’s for 2635. The next line item is for counting in this for our financial audit firm. Their their fees of just increased this year after the budget was already.
23:39 The next one is psychological counseling within which is in the health department. So this is actually a contract that it went slightly over. So we’re going to work with the health department. So recruit any any costs that went over above that contract but dollars and then the last one is legal notices for $100. I believe we’re anticipating to get Grant Revenue. We’re just not sure it’s going to be fun tomorrow. So just discovered that’s on a photo is 260,095.
24:16 Okay. Thank you. Michael here could be the members have any questions? These items again. This is an annual kind of throughout the video players. this Billy’s informative assassination. I’d like to make emotions. in accordance with a Mass General Law chapter 24 section 3D the the select board authorizes the transfer of thumbs from fiscal year 22 appropriation. Y9 is listed below title transfer from the fiscal year 22 Corporation lab. Let’s see below titled transferred to As submitted by the town’s interim finance
25:01 department said transfers subject to the concerns of the towns financing. all in favor Thank you very much. Good job. Appreciate it. Thank you. Next time our agenda is a common Big Apple case. Yes, if Fernanda deoliviera this year right? Come on, I see join us. Because everyone good good opportunity and it’s just for eat. Well it yeah welcome. So just a little bit ground about myself. My name is frenanda. I’ve been working here in this round of Marblehead for the past two years with susanette and well kitchen. At first I started as a manager and
25:49 she just, you know brought the opportunity to purchase the business. And of course I yes, it’s a great opportunity. I’ve been in the food business for the past 10 years on and off. And I want to say be well kitchen fit me if it’s you know with my lifestyle as far as clean and healthy food. And I took the chance here. I am. Yeah good for you. It’s always exciting right people making a commitment to the end of the business practices in town. Yes, and I love the town. Beautiful time, so just
26:35 here. Thank you guys. Take me crazy. What’s any questions any comments what she just she best of that. Thank you so much. Hope to see you.
26:54 Well, we’re very pleased to I’m very pleased to make the motion here. To approve the application of a common bitter and license for eat. Well kitchen. Well Atlantic Avenue hours of operation Monday through Sunday 8 AM 4 pm subject to receive all applicable inspection sign awesome. All these paid and seating capacity is 16, okay.
27:23 Respect you guys. Thank you.
27:33 Things and I think we have a moving to vote right now. And first vote item on the agenda is licensing or one day entertainment This is for the beacon. 123 Pleasant Street And basically it is about a one day outdoor entertainment license for the patio area from 12. Just four not to celebrate the first year anniversary of
28:10 Yesterday excited today. That’s why we’re moving it to the agenda. Okay, exactly, right and that’s right. So okay same actually right into in an hour and a half some people. I don’t want that right under consideration. yeah, so anyway, you know this any comments Jackie just that remind them that this is a one-day license and
28:43 In order to have any other kind of license from music they have to come back to us. This is you know, that that’s what that’s well noted. Yeah. This is over one day license for an amazing, you know celebration right here one year’s success. So sounds great good kickoff to the festival runs and everything. So they’re almost I can make a motion. To for requests from Michael tumulty event coordinator that he can restaurant 143 Pleasant Street for one day license for Thursday, June 20th. 2022 from 12 Years the 4 pm. So cool. Okay all day. Okay promotion is passed.
29:33 Okay. Now we have two contracts here which we will take in order. And the first is a motion to amended contract. For exterior painting of the police station between the town and John Florissant coincies by increasing the contract amount $4,000 and authorize the chair to sign on the half. of the board and the color more rotted wood was found that is not visible and needs to be repaired and replaced These funds are within the amount of appropriated for the project. So it’s just a again a change order that falls under the contingency. Someone won’t know later.
30:22 The second one is emotion to amend the contract for the State Street restroom project between the town and MGS construction team has been increasing the contract and now 2,903 dollars in 18 cents an authorization on behalf of the road. This increases due to unknown repair that was needed to just really Plumbing like from Winter freeze. The supply of automatic on World’s locks is fun within the 550,000 earmarked received by the town from the state. So again, you know someone second
31:10 a little better. Do we have a timeline on that? I’m just gonna yeah, but it didn’t say anything and well, we’re pushing them before the open for the floor. And there now?
31:27 too
31:29 fully go around tables Nothing gradually Becky again, really? You know another Grant. If you wouldn’t mind. Talking about it or giving up. So we applied for Mass Trails Grant. We are the lead community and Salem is participating and it is to do the design and permitting from where the bike path in Salem ends on Lafayette Street to lead Mills and including in all through LED Mills and the idea is to design something that’s consistent with our rail trail master plan. So that would be the prototype for the new the new
32:15 Trail. So it would be deconstructed Granite at a with that is uniform. And if you notice when you walk along there’s these beautiful views that are there’s a big fence up there with vines on it. So something that would you know replace both of those. Bridges and make them accessible and also have improved the Vista. Sometimes yes, so this is for the design and the permanent organization all that and then the next would be the construction needed to complete streets are for some combination. So it’s a great setup. It’s the guys kind of information. We need to make informed spending decisions. So it’s really
33:01 great. Any any afghanas, you know, it’s not just again back. Yeah. Thank you. Okay, I think we’re the point where? we go around with David and anything anything and really just go have fun Marblehead and support the July where we have the information about the festivals that all on our website or chamber Commerce that’s on the I think it’s on the that’s right. It’s a question tomorrow. It’s own website my webs. ite Marblehead store, okay. That’s good to note. Again, yes this past Saturday down at State Street Landing. Actually, Jackie goes first no and I’ll
33:48 add it. Yeah going okay. The Marblehead disabilities commissioned had a dedication ceremony for a new sling lift, which is also known as a Hoyer limit that’s being it that was installed in the straight State Street Landing in Marblehead. It’s the first lift of its kind on model at Harbor and it will permit residents with Mobility limitations to safely board boats. The purchase of the living was made possible by generous gift by the Mariner Marblehead and Jim Moses and I’m lucky enough to be there. It was a really special event Harbor Masters, were there disabilities and Mission
34:34 was there. Lots of just people coming to see it and it was really it was really really special. It was great. It was a nice collaboration between the disabilities commission and Harrison Waters and we need Amy at first time to speak more. She was she was fantastic. She’s really good. Yeah, I concur right here to see. the folks in You know people were disabled really participating in the event the great volunteers. Yeah and enthusiastic. Yeah. And so she actually jumped me over here jumping into the city, okay?
35:24 good stuff Never mind, is that go Aaron and say everybody have a fantastic.
35:33 Because with that and support all our things. Last night I jumped on the planning board meeting. They were discussing an accessory dwelling units and it was really interesting and it seemed very positive everybody who spoke was positive and I look forward to their continuing this work and bringing it to us. when when appropriate? Thank you. That’s right about emotion of a journey, so won’t second. We are German. Oh, yeah.
